Texas House Speaker Dismisses HD135 Election Contest Petition
‘This is exactly the outcome we were expecting,’ Says HCDP Chair
On Jan. 9, 2023, Dade Phelan, Speaker of the Texas House of Representatives, dismissed the petition filed by Mike May, the losing opponent of the Texas House District 135 election. The Speaker cited “failure to timely file security for costs,” as the reason for the dismissal.
The original petition was filed on Dec. 1, 2022, by Mike May, who lost his election to State Representative Jon Rosenthal by 5000 votes. According to the dismissal, security costs for the petition were due no later than Dec. 9, 2022.
“This is exactly the outcome we were expecting,” said Harris County Democratic Party Chair Odus Evbagharu.
“These baseless accusations pushed by desperate candidates like May continue to fuel election denialism in Texas.
"This feeble attempt to grasp at straws has become a sad tradition for Republican candidates.
"Mike May has not only wasted his time but the time of those elected to serve the people of Texas.
“I’m happy that Representative Rosenthal can now spend his time this session focusing on passing legislation that will improve the lives of the residents of House District 135.
“We hope to see the same results with the Election-denying lawsuits happening against our candidates, who were fairly elected and sworn in to fulfill their constitutional duties.”
